Refund and Cancellation Policy

At 3 Orbit Solutions, we pride ourselves on delivering high-quality, tailored IT services, solutions, and digital experiences to our clients across the US, UAE, Malaysia, and beyond. Given the customized nature of our offerings, which range from design and development to consulting, enterprise solutions, marketing, infrastructure, and more, this policy defines our refund and cancellation terms to ensure fairness, transparency, and professional integrity.

1. General Refund Policy

Due to the bespoke nature of our services, full refunds are generally unavailable once project work begins. However, partial refunds or suitable resolutions may be considered under the following conditions:

  • The refund request is made within five business days of the initial payment.
  • The project is in its early stages or has not yet started.
  • The client submits a written explanation with the refund request.

2. Eligibility for Refunds

You may be eligible for a refund under the following circumstances:

  • Before Work Begins: Full refund minus transaction fees if requested within 24 hours of payment and if no work has started.
  • Client-Initiated Cancellation: A partial refund may be offered if the project is cancelled before reaching 30% completion.
  • Non-Delivery of Services: If 3 Orbit Solutions is unable to deliver due to internal issues or force majeure, a prorated or full refund will be issued based on the project's progress.

3. Service-Specific Refund Conditions

Due to differing service scopes, refund terms vary as follows:

a. Web Development & Software Projects

  • Full Refund: If cancelled before development or design begins.
  • Partial Refund: If design/coding work has started but not completed.
  • No Refund: Once final deliverables (e.g., code, assets, access) are handed over.

b. Branding, UI/UX & Design Services

  • Partial Refund: If no concepts or wireframes have been shared.
  • No Refund: After sharing any drafts or visual assets.

c. Digital Marketing & SEO

  • No Refund: After the campaign launch or when any third-party tools or ad budgets are used.

d. Consulting & Strategy Sessions

  • No Refund: For attended strategy/consultation sessions.
  • Partial Refund: If cancelled 48+ hours before the scheduled time.

e. Enterprise Solutions & System Integration

  • Partial Refund: Based on unused modules or services.
  • No Refund: Once deployments or integrations begin.

f. Infrastructure & Managed IT Services

  • Service Credits may be issued for SLA violations, not refunds.
  • No Refund: For subscription billing cycles already completed.

4. Non-Refundable Situations

Refunds will not be issued under the following conditions:

  • Final deliverables approved and submitted.
  • Change of mind or shifted expectations outside of the signed scope.
  • Client delays, lack of cooperation, or missed approvals.
  • Third-party purchases already initiated (hosting, ads, licenses).
  • Downloaded digital products or proprietary tools accessed.
  • Projects where scope creep occurred without scope or budget approval.

5. Revisions & Resolution First Policy

Before requesting a refund, clients must first:

  • Utilize revision rounds as outlined in the service agreement.
  • Communicate concerns directly for resolution.
  • Refunds will not be considered until a reasonable attempt at resolution is made.

6. Cancellation Policy

To cancel a project:

  • Submit a written request to sales@3orbitsolutions.com.
  • If cancelled within 24 hours of the order and no work has begun, a full refund minus transaction fees will be provided.
  • If Work begins: The refund depends on the service type and project stage.
  • Subscription/multi-phase projects: Future phases can be cancelled; completed Work will not be refunded.

7. Refund Request Process

To request a refund:

  • Please email us at sales@3orbitsolutions.com with the Order ID, Project Name, and Refund Reason.
  • Requests are reviewed within 5–7 business days.
  • Approved refunds are processed in 7–14 business days via the original payment method.
  • All payment processor fees (e.g., Stripe, PayPal) are deducted from the refund.

8. Chargebacks and Disputes

Clients agree to exhaust internal support options before filing any chargeback. 3 Orbit Solutions reserves the right to challenge unjustified chargebacks with documented proof of services, approvals, and communication.

9. Force Majeure

We are not liable for delays or non-performance caused by:

  • Natural disasters or emergencies.
  • Platform or server outages.
  • Wars, political unrest, or pandemics.
  • Government regulations or restrictions.

10. Client Cooperation Clause

Refunds may be voided or denied if:

  • Clients fail to provide timely feedback, approvals, or required assets.
  • Communication is unresponsive for extended periods.
  • Your collaboration is crucial to the project's success and timely delivery.

11. Third-Party Service Dependency

Projects relying on third-party platforms (e.g., AWS, Meta Ads, Google APIs, OpenAI) are subject to the availability and policy terms of these platforms. 3 Orbit Solutions is not liable for refunds resulting from third-party disruptions, downtimes, or pricing changes.

12. Currency & International Transactions

  • Refunds are processed in the original transaction currency (USD).
  • International bank fees and currency conversion losses are the client's responsibility.

13. SLA Breach & Downtime Credits

If you are under a managed IT or SLA-backed contract:

  • We offer service credits (not refunds) if agreed-upon uptime or response SLAs are not met.
  • Service credits are applied toward future invoices or renewals.

14. Termination by 3 Orbit Solutions

We reserve the right to terminate any service or contract without refund in cases of:

  • Abusive behavior or threats toward staff.
  • Fraudulent activity.
  • Policy or legal violations.
  • Suspicion of misuse or unethical business practices.

15. Trial, Proof of Concept & Pilot Services

  • Trial or POC services are non-refundable unless specified in writing.
  • These are offered to demonstrate capability with limited scope and cost.

16. Ownership on Refund

In case of project cancellation or refund:

  • All deliverables, code, documentation, and creative assets remain the intellectual property of 3 Orbit Solutions.
  • The client cannot use, modify, or distribute any materials provided before the refund.

17. Policy Updates

This Refund & Cancellation Policy may be updated at any time. Changes will be posted on this page with a revised effective date. Clients are encouraged to review periodically.
